POCKET ARBORIST TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your access to and use of the Pocket Arborist mobile application, website, and related services (collectively, the “App”). The App is owned and operated by Four Roots Co. LLC, doing business as Pocket Arborist (“Pocket Arborist,” “we,” “us,” or “our”).

  1. ACCEPTANCE OF TERMS

By downloading, accessing, creating an account for, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the App.

  1. INFORMATIONAL AND EDUCATIONAL PURPOSES

Pocket Arborist provides AI-assisted plant health, lawn, tree, and shrub information for general informational and educational purposes. The App does not provide professional engineering, legal, safety, tree-risk-assessment, pesticide, emergency, or other licensed professional services.

Information provided by the App is a preliminary assessment and is not a substitute for an on-site inspection or the judgment of a qualified professional.

  1. AI-ASSISTED RESULTS AND NO GUARANTEE OF ACCURACY

The App may use artificial intelligence, image analysis, structured datasets, seasonal information, geographic information, and information supplied by users to identify possible plant, lawn, tree, or shrub conditions.

Results may be incomplete, inaccurate, delayed, or incorrect. Similar symptoms may have different causes, and photographs may not show all relevant conditions. Pocket Arborist does not guarantee any diagnosis, identification, confidence score, recommendation, treatment suggestion, or other result.

Results identified as low confidence or as a likely issue should be treated only as an initial indication that additional investigation may be needed.

  1. NO PROFESSIONAL RELATIONSHIP

Use of the App does not, by itself, create an arborist-client, consultant-client, contractor-client, fiduciary, or other professional relationship between you and Pocket Arborist, its developers, participating contractors, service providers, affiliates, or partners.

A professional relationship with a participating contractor may arise only through a separate agreement made directly between you and that contractor.

  1. TREE RISK AND HAZARD DISCLAIMER

The App is not a tree risk assessment tool and does not determine whether a tree is hazardous, structurally unsafe, or likely to fail.

Do not rely on the App to make decisions concerning tree safety. Trees with dead or hanging branches, cracks, cavities, decay, root damage, substantial lean, storm damage, soil movement, construction damage, or proximity to people, buildings, vehicles, utilities, or other targets should be inspected in person by a qualified arborist.

  1. EMERGENCIES

The App must not be used in an emergency. If a tree, branch, plant condition, chemical exposure, or other situation presents an immediate threat to people or property, move away from the affected area and contact emergency services, the appropriate utility company, or a qualified local professional.

  1. TREATMENT TIMING, WEATHER, AND SEASONAL INFORMATION

Treatment timing, growing-degree-day information, weather information, seasonal alerts, pest or disease activity notices, and geographic trends are estimates only.

Actual conditions may vary because of weather, microclimates, geography, plant species, plant development, site conditions, data availability, and other environmental factors. You are responsible for confirming actual site conditions before making treatment or management decisions.

  1. PESTICIDES, FERTILIZERS, AND OTHER TREATMENTS

The App does not replace pesticide labels, product instructions, state or federal regulations, licensing requirements, or professional judgment.

Always read and follow the current product label. The label is the law. You are solely responsible for the lawful and safe selection, handling, storage, mixing, application, and disposal of pesticides, fertilizers, and other treatment products.

  1. CONTRACTORS AND SERVICE PROVIDERS

The App may connect users with a participating tree care, lawn care, landscape, plant health care, or other service provider.

The display of or connection to a contractor does not constitute a warranty, certification, endorsement, or guarantee by Pocket Arborist concerning that contractor’s qualifications, availability, pricing, workmanship, licensing, insurance, recommendations, or services.

Contractors are independent businesses and are not employees or agents of Pocket Arborist. Any estimate, inspection, treatment, work authorization, payment, warranty, or other service arrangement is solely between the user and the contractor.

  1. SERVICE REQUESTS

When you submit a request for professional assistance, an inspection, an estimate, pruning, removal, treatment, or another service through the App, relevant information may be sent to the participating contractor associated with your account.

Submitting a request does not obligate you to hire the contractor, does not guarantee that the contractor will contact you, and does not create a binding service agreement. The contractor may need to inspect the property before providing advice, pricing, or services.

  1. USER ACCOUNTS

You agree to provide accurate and current account information and to keep your login credentials secure. You are responsible for activity conducted through your account.

You may not share your account in an unauthorized manner, misuse contractor codes or access links, impersonate another person, interfere with the App, attempt to gain unauthorized access, reverse engineer the App except where expressly permitted by law, or use the App for unlawful or abusive purposes.

We may suspend or terminate access when reasonably necessary to protect users, contractors, the App, or our business.

  1. USER-SUBMITTED CONTENT

You may upload photographs, notes, property information, location information, comments, and other content. You represent that you own the submitted content or have the legal right and permission to submit it.

You grant Pocket Arborist a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, analyze, and display submitted content as reasonably necessary to operate, maintain, secure, support, and improve the App and provide requested services.

As between you and Pocket Arborist, you retain any ownership rights you have in your original content. The App is not a photo-storage or backup service. You are responsible for keeping copies of photographs and other content you wish to preserve. Pocket Arborist does not guarantee that submitted content will remain available for viewing, downloading, or retrieval, subject to any rights provided by applicable law.

  1. DATA AND PHOTO USE

Submitted photographs, diagnostic activity, service-request activity, geographic information, usage patterns, system performance information, and associated data may be used to:

• Operate and support the App;
• Generate AI-assisted results;
• Route service requests to the appropriate contractor;
• Troubleshoot errors and improve system performance;
• Improve diagnostic accuracy, datasets, and application features;
• Analyze pest, disease, plant-health, and geographic trends; and
• Create aggregated or de-identified analytics.

Personal information will be handled according to the Pocket Arborist Privacy Policy.

  1. ACCOUNT AND DATA DELETION

Users may delete their account through the App. Account deletion is subject to reasonable processing time and any limited retention permitted or required for security, fraud prevention, dispute resolution, legal compliance, or other legitimate business purposes.

  1. INTELLECTUAL PROPERTY

The App, including its software, design, branding, text, graphics, databases, diagnostic systems, workflows, and other original content, is owned by or licensed to Four Roots Co. LLC and is protected by applicable intellectual-property laws.

These Terms provide you with a limited, personal, nonexclusive, nontransferable, and revocable right to use the App for its intended purposes. They do not transfer ownership of the App or its intellectual property to you.

  1. NO WARRANTY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AVAILABILITY, TITLE, AND NON-INFRINGEMENT.

Pocket Arborist does not guarantee uninterrupted access, error-free operation, contractor availability, or that the App will meet every user’s needs.

  1. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUR ROOTS CO. LLC, POCKET ARBORIST, AND THEIR OWNERS, EMPLOYEES, DEVELOPERS, LICENSORS, CONTRACTORS, AFFILIATES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE APP.

This includes, without limitation, property damage, plant or tree loss, tree or branch failure, treatment costs, business loss, lost profits, loss of data, personal injury, or decisions made in reliance on App information.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

  1. USER RESPONSIBILITY

You assume responsibility for decisions made using information from the App. Seek an in-person evaluation from a qualified professional before making significant treatment, pruning, removal, construction, tree-safety, pesticide, or property-management decisions.

  1. SERVICE AVAILABILITY AND CHANGES

App features, supported plants and conditions, diagnoses, service areas, participating contractors, alerts, pricing, and availability may change at any time.

Features shown in marketing materials, screenshots, demonstrations, development previews, or beta versions may not be included in the current version of the App.

  1. GEOGRAPHIC AND COVERAGE LIMITATIONS

Plant coverage, diagnostic support, seasonal information, contractor availability, and treatment guidance may be limited by geographic region, species, service area, data availability, or current App capabilities.

  1. TERMINATION

You may stop using the App at any time and may delete your account through the App.

We may restrict, suspend, or terminate access if you violate these Terms, misuse the App, threaten the security or operation of the App, or create legal or safety risks for Pocket Arborist, contractors, or other users.

  1. CHANGES TO THESE TERMS

We may update these Terms periodically. Updated Terms will be posted through the App or associated website with a revised effective date.

We may provide additional notice or request renewed acceptance when a change materially affects users’ rights or when required by applicable law. Your continued use of the App after the revised Terms become effective constitutes acceptance of the updated Terms.

  1. GOVERNING LAW

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

  1. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be enforced to the greatest extent permitted by law.

  1. ENTIRE AGREEMENT

These Terms and the Pocket Arborist Privacy Policy constitute the agreement between you and Pocket Arborist concerning your use of the App, except for any separate written agreement that may apply to contractor participation or professional services.
